RETURN AND REFUND POLICY

PLEASE READ THIS BEFORE YOU PLACE AN ORDER
Chicago Traders sells bulk agricultural commodities for export. Every order is
milled, packed and shipped to the buyer's own specification. Once an order is
confirmed we commit to the mill, book the freight and begin production, and
none of that can be undone.
ALL SALES ARE FINAL. WE DO NOT ACCEPT RETURNS. WE DO NOT ISSUE REFUNDS.
WE DO NOT ACCEPT CANCELLATIONS ONCE AN ORDER IS CONFIRMED.
Please make certain of your specification, your volume, your destination and
your import requirements before you order. Ask us every question you have in
advance. We would far rather spend an hour answering questions than have you
commit to an order you are not sure about.
1. NO RETURNS
Goods sold by Chicago Traders are not returnable under any circumstances.
Once a shipment has left our origin facility it cannot be returned, exchanged,
substituted or credited.
2. NO REFUNDS
We do not issue refunds. This includes, without limitation:
- Change of mind, buyer's remorse, or an order placed in error
- A fall in the market price after your contract date
- Your buyer, distributor or end customer cancelling on you
- Failure to obtain an import permit, licence or registration
- Rejection, delay or seizure at the destination by customs or any authority
- Labelling, certification or regulatory requirements at destination that were
not stated to us in writing before the contract was signed
- Delay in transit, port congestion, carrier schedule changes or transhipment
delays
- Demurrage, detention, storage or any charge arising after arrival
- Deterioration, infestation, moisture damage or spoilage occurring after risk
has passed to you under the agreed Incoterm
- Loss or damage in transit, which is a matter for the carrier or the cargo
insurer, not for us
- Natural variation in colour, aroma, kernel length, texture or cooking
behaviour between crop years and lots
- Weight or grade variance falling within the contract tolerance
- Any loss of profit, loss of onward contract, or other indirect or
consequential loss
3. NO CANCELLATION
An order is binding from the moment a proforma invoice or sales contract is
signed and the payment instrument is established. From that point the full
contract value is payable in every case, whether or not production has begun,
whether or not the goods have loaded, and whether or not you still require them.
If you are not completely certain about an order, do not confirm it.
4. THE ONE EXCEPTION
The only circumstance in which money is returned is where Chicago Traders
fails to ship the goods at all and no shipment is made against your payment.
In that single case the amount paid is returned to the originating account,
less any bank charges and less any documented costs already incurred on your
behalf. No other exception exists.
5. VERIFY BEFORE YOU BUY, NOT AFTER
Because there is no remedy after shipment, we give you every opportunity to
satisfy yourself before it:
- Pre-shipment samples are couriered on request, before you confirm
- You may appoint your own independent surveyor — SGS, Intertek, Bureau
Veritas or any firm you or your bank nominate — to draw samples, verify
grade and weight, and witness loading at origin, at your cost
- You may inspect at origin in person, or send your own representative
- Full specification, grade, moisture, broken percentage, packing and
certification are stated on the contract before you sign
Once you have signed the contract and the goods have shipped, you are taken to
have accepted the goods as conforming. Any point you wish to verify must be
verified before loading, because it cannot be raised afterwards.
6. PAYMENT DISPUTES AND CHARGEBACKS
These are business-to-business export transactions settled by letter of credit,
telegraphic transfer or documentary collection. They are commercial contracts
between companies and are not consumer purchases.
By placing an order you agree that you will raise any question directly with
Chicago Traders and will not initiate a chargeback, payment reversal or bank
dispute. Doing so is a breach of these terms.
We retain the complete file for every order — the signed contract, the proforma
invoice, the specification, the independent survey report, container and seal
numbers, loading photographs, the full shipping document set and all
correspondence — and we will present that record in full to any bank, card
issuer, payment provider or tribunal in response to any dispute. Costs of
defending a dispute raised in breach of this clause are recoverable from the
buyer.
7. GOVERNING LAW
This policy is governed by the laws of the State of Arkansas, United States,
without regard to conflict of law rules. The United Nations Convention on
Contracts for the International Sale of Goods does not apply. Any dispute not
resolved by negotiation shall be referred to binding arbitration under the
rules of the American Arbitration Association, seated in Arkansas.
